Legal Advice

The information contained on this web site is not legal advice, nor should it substitute for the assistance of a qualified attorney. Legal practice in Ohio is restricted to attorneys who are licensed by the Supreme Court of Ohio. In order to become a licensed attorney in the State of Ohio, persons must obtain a bachelor's degree from an accredited college or university, they must obtain a juris doctorate degree from an accredited college of law, they must then pass the bar examination administered by the Ohio Supreme Court. If an adult wishes to represent themselves in court, that person may do so. Parents may speak for their minor children, but they are not permitted to represent their minor children as an attorney unless they are themselves a licensed attorney. Persons who are incapable of paying a private attorney may qualify for an appointed attorney paid for by the taxpayers.

Limitations on Court Staff

The forms and instructions provided on this web site are provided as a public service to you. The employees of the court including deputy clerks are not attorneys and therefore cannot answer questions about the legal issues you, your family or your child may be facing.

Gov. Bar R. VII, sec. 2(A) defines the unauthorized practice of law as the "rendering of legal services for another by any person not admitted to practice in Ohio under Rule I and not granted active status under Rule VI, or certified under Rule II, Rule IX, or Rule XI of the Supreme Court Rules for the Government of the Bar of Ohio." The definition of the unauthorized practice of law is further developed on a case-by-case basis by the Supreme Court of Ohio.

It is illegal for the court staff to give you advice on legal issues. The Supreme Court of Ohio enforces the rules against the unauthorized practice of law.

If someone on our staff declines to give you information on the choice of form to use to advance your case, how to fill out the forms, or what steps you should or should not take in your case, please realize they are declining to advise you on legal issues. Please do not perceive the court staff as being unwilling to be help to you. They are merely executing their sworn responsibility to follow the law.
